STATEMENT ON RAILWAY ACCIDENT AND INCIDENT INVESTIGATION POLICY
This statement sets out AGIFER's policy for the investigation of rail accidents involving actors in the Romanian rail transport system, including those incidents which under slightly different conditions may lead to serious accidents. It is our policy that such cases will be investigated in accordance with the provisions of the Railway Safety Act, relevant regulations and standards, establishing and maintaining an efficient and effective investigation programme to achieve this objective.
Railway incidents will be selected for investigation by AGIFER, based on the requirements of Act 55/2006 and HGR 1 17/2010, and the initial estimate of the degree of potential improvement in railway system performance that could result from such an investigation will be carefully weighed in the decision to appoint the investigation committee.
Trained investigators will promptly investigate all selected accidents or incidents using the best available investigation technique and technology. The primary purpose of these investigations is to determine what happened and why it happened? We want each investigation to provide a timely, coherent, unbiased, objective, valid description and explanation of the accidental process.

All investigative findings will be supported by convincing logic and supporting data, and subjective opinions, unspoken conclusions or arbitrary, generalized statements are unacceptable in the investigative report. AGIFER investigators must ensure that all their work products will meet objective quality assurance criteria before submitting their final work reports.
If, at any time during the course of an investigation, an investigator finds indications that there has been an intentional action with intent to harm the rail system that may be implicated in the occurrence of the case under investigation, the investigator will immediately contact AGIFER management to notify the appropriate investigating authorities.
The new knowledge about railway safety obtained from the investigations will be distributed in accordance with the law or legal regulations to any person in a position to act on the information or to improve the future performance of the railway economic organization, as well as to the Romanian state authorities,
When AGIFER investigators work with or under the guidance of investigators from other organisations in the European Union, in accordance with applicable statutes or contractual agreements, our staff must comply with these policy guidelines, in particular with regard to investigation quality assurance procedures. 

The effectiveness of investigations and their reports will be evaluated at least annually for alignment with this policy, and the program evaluation report may be made available to senior managers upon request.
The implementation of this policy will be the responsibility of the Director General of AGIFER. All employees and contract staff are responsible and accountable for providing the necessary support to enable AGIFER to implement this policy for the investigation of accidents and incidents occurring on the Romanian railway system.
